Terms of sale

1. Purpose
These general terms of sale govern sales made on the swordsmoke.com website between [seller's name / company name], hereinafter “SwordSmoke”, and any natural person acting as a consumer, hereinafter “the customer”. Placing an order implies full acceptance of these terms. The contract may be concluded in French, Spanish or English, depending on the website language chosen by the customer.
2. Products
The products offered are decorative LED swords with a smoke effect, with a blunt blade, intended for cosplay, decoration and content creation. Their essential characteristics are presented on the product page. Photographs are as accurate as possible; the 3D preview on the home page is an illustration. Recommended for ages 14 and up; younger users should use it under adult supervision.
3. Prices
Prices are shown in euros, including all taxes [or “VAT not applicable, art. 293 B of the French Tax Code” depending on your status]. Tracked shipping is free in the areas we deliver to (the 27 European Union countries and Monaco, see the Shipping & returns page). The applicable price is the one displayed when the order is confirmed.
4. Orders
The customer selects their products, checks the contents of their cart and confirms the order on the secure payment page. An order confirmation is sent by email. SwordSmoke reserves the right to cancel an order in the event of a previous dispute or a payment irregularity; the customer is then refunded in full.
While online payment is not yet available, the customer may send a reservation request: it does not commit them to anything until they pay for the order through the secure payment link sent to them.
5. Payment
Payment is made online by card, Apple Pay or Google Pay through Stripe's secure platform. The amount is charged when the order is confirmed. SwordSmoke never has access to the customer's bank details.
6. Delivery
Products are delivered to the address given when ordering, as a tracked parcel. Estimated delivery times and terms are detailed on the Shipping & returns page. If the parcel arrives damaged, the customer should report it to the carrier and contact SwordSmoke within 48 hours with photos.
7. Right of withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has 14 days from receipt of the product to exercise their right of withdrawal, without giving any reason. They simply need to send a clear statement (for example, the form below) to contact@swordsmoke.com.
The product must be returned complete (sword, scabbard, accessories) within 14 days of notifying the withdrawal decision. Return costs are borne by the customer [to be confirmed]. The customer may be held liable for any loss in value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning.
SwordSmoke refunds all sums paid, including the initial delivery costs, no later than 14 days after being informed of the withdrawal decision, using the same means of payment. The refund may be withheld until the product has been received back or until the customer has supplied proof of having sent it.
8. Legal guarantees
All products are covered by the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).
The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, they only need to establish that the lack of conformity exists, not the date on which it appeared.
The legal guarantee of conformity includes the obligation to provide all updates needed to keep the goods in conformity. It entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them. If the goods are repaired under this guarantee, the consumer benefits from a six-month extension of the initial guarantee.
The consumer may obtain a price reduction while keeping the goods, or terminate the contract and receive a full refund in exchange for returning the goods, if the seller refuses to repair or replace them, if the repair or replacement takes place after thirty days, or if the defect is so serious that it justifies an immediate price reduction or termination of the contract.
The consumer may also invoke the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code) within two years of discovering the defect.
9. Use and safety
The customer agrees to use the product in accordance with its instructions: do not use the blunt blade to strike hard objects, do not inhale the vapour, use the smoke effect in a well-ventilated space, only use suitable nicotine-free smoke oil, do not expose the product to moisture or high temperatures, and charge it with the cable provided.

11. Mediation and disputes
In the event of a complaint, the customer can contact SwordSmoke at contact@swordsmoke.com. If no amicable solution is found, and in accordance with Articles L612-1 et seq. of the French Consumer Code, the customer may refer the matter free of charge to the following consumer mediator: [name and contact details of the mediator you have signed up with].
These terms are governed by French law, without prejudice to any more protective mandatory provisions of the law of the consumer's country of habitual residence.
